1. INTRODUCTION & ACCEPTANCE OF TERMS
Welcome to AspireAus Migration Services (“AspireAus”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your use of our website (aspireaus.com.au), online tools, initial consultations, and our professional migration and education consulting services.

AspireAus is owned and directed by Principal Registered Migration Agent Rajbir Singh Deol (MARN: 2418409), registered with the Office of the Migration Agents Registration Authority (OMARA) under the Migration Act 1958 (Cth), located at 121 King William Street, Adelaide, SA 5000, Australia.

By browsing our website, booking a consultation, or engaging our services, you agree to be bound by these Terms, our Privacy Policy, and relevant Australian migration laws. If you do not agree to these Terms, please refrain from using our website or services.

2. NATURE OF INFORMATION & SCOPE OF SERVICES

a. Informational Content Only:
All materials, articles, points calculators, eligibility guides, and publications available on our website or social media platforms are provided solely for general informational purposes. They do not constitute formal legal advice or a binding assessment of your individual immigration status.

b. Initial Consultations:
An initial consultation (whether in-person at our Adelaide CBD office, via phone, or via video conference) allows us to evaluate your personal background, assess potential visa pathways, and discuss strategic options. An initial consultation does not constitute ongoing representation or the lodgement of a visa application.

c. Formal Agency Representation:
A formal agent-client relationship commences only after:
(i) Both parties have signed a formal written Agreement for Services and Fees (Consumer Agreement); and
(ii) Form 956 (Appointment of a Registered Migration Agent) has been executed and lodged with the Department of Home Affairs (DoHA).

3. NO GUARANTEE OF VISA APPROVAL OR TIMELINES
In strict accordance with the OMARA Code of Conduct:
a. AspireAus cannot and does not guarantee the grant, outcome, or approval of any visa application, citizenship matter, skills assessment, or tribunal appeal.
b. Visa decision-making authority rests solely and exclusively with the Department of Home Affairs (DoHA), relevant state nomination authorities, and judicial/tribunal bodies.
c. Processing times published on our website or discussed during consultations are indicative estimates based on current Departmental service standards and are subject to change without notice.

4. REGULATORY COMPLIANCE & OMARA CODE OF CONDUCT
As Australian Registered Migration Agents, we operate under strict statutory obligations set out in the Migration Act 1958 (Cth) and the Migration (Code of Conduct) Regulations 2021.
– You have the right to receive a copy of the official OMARA Consumer Guide prior to or upon engaging our services.
– The official OMARA Code of Conduct can be inspected at www.mara.gov.au.

5. CLIENT RESPONSIBILITIES & DUTY OF FULL DISCLOSURE
To ensure accurate assessment and compliant lodgement, you agree to:
a. Full Honesty & Accuracy: Provide complete, accurate, truthful, and up-to-date information regarding your personal history, marital/de facto status, employment records, qualifications, finances, medical history, and character/criminal background.
b. Genuine Documentation: Supply only authentic, unmanipulated, and verified documents. Submitting false, misleading, or bogus documentation to the Department of Home Affairs violates Public Interest Criterion (PIC) 4020, resulting in mandatory visa refusals and long-term re-entry bans.
c. Timely Instructions: Provide requested documents, translations, and application details within specified deadlines to ensure statutory lodgement timelines are met.
d. Status Updates: Immediately notify AspireAus of any changes in your circumstances (e.g., change of address, passport, relationship status, employment termination, or visa notifications).

6. FEES, PAYMENTS & CLIENT TRUST ACCOUNTS

a. Professional Fees:
Our professional fees for immigration services are outlined in an itemised, transparent written Agreement for Services and Fees provided prior to formal engagement.

b. Third-Party & Statutory Disbursements:
Professional fees are separate from statutory and third-party fees, which must be paid by the client. These include, but are not limited to:
– Department of Home Affairs visa application charges (VAC);
– Skills Assessing Authority assessment fees;
– State/Territory government nomination fees;
– Medical examination fees (Bupa Medical Visa Services);
– National and overseas police clearance fees;
– NAATI-certified translation and English language testing fees (IELTS/PTE).

c. Client Funds & Trust Account Management:
In compliance with OMARA financial management standards, client advance funds for professional services and disbursements are held securely in a dedicated Client Account (Trust Account) and are only withdrawn upon the completion of agreed milestones and issuance of a formal tax invoice.

7. CANCELLATION & REFUND POLICY

a. Initial Consultations:
Consultation bookings may be rescheduled or cancelled with at least 24 hours’ prior written notice. Cancellations made with less than 24 hours’ notice or client no-shows are non-refundable.

b. Formal Service Agreements:
If a client terminates a formal agreement before matter completion:
– Professional fees are refundable solely for milestones or work that has not yet commenced or been performed;
– All completed legal work, case research, document drafting, and consultations up to the date of termination will be billed at agreed hourly or milestone rates;
– Statutory fees already disbursed to the Department of Home Affairs or third-party assessment bodies are non-refundable by those entities.

8. PRIVACY, CONFIDENTIALITY & RECORD RETENTION

a. Privacy Compliance:
We collect, use, and store personal and sensitive information in strict compliance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and our Privacy Policy.

b. 7-Year Statutory Record Retention:
Pursuant to Section 61 of the OMARA Code of Conduct, AspireAus is legally required to retain complete client matter files and correspondence securely for a minimum period of seven (7) years following file closure.

9. INTELLECTUAL PROPERTY
All website content, proprietary calculators, text, design, logos, graphics, and layout on aspireaus.com.au are the intellectual property of AspireAus Migration Services and are protected by Australian copyright laws. Unauthorized reproduction, modification, or distribution is strictly prohibited.

10. LIMITATION OF LIABILITY
To the maximum extent permitted by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010):
a. AspireAus shall not be liable for any indirect, incidental, special, or consequential loss arising from client delays, third-party processing timelines, legislative amendments, or adverse visa decisions made by assessing bodies or the Department of Home Affairs.
b. If any statutory guarantee applies that cannot be excluded, our liability is limited strictly to the re-supply of the services or the cost of having the services re-supplied.

11. TERMINATION OF ENGAGEMENT
a. By Client: You may terminate our services in writing at any time, subject to the settlement of all outstanding invoices for work completed.
b. By AspireAus: We reserve the right to terminate representation if:
– A client fails to provide truthful disclosures or insists on submitting fraudulent documentation;
– A client fails to pay agreed professional fees or disbursements within required payment terms;
– A conflict of interest arises that cannot be resolved under the OMARA Code of Conduct; or
– Irreconcilable breakdown in professional communication occurs.

12. DISPUTE RESOLUTION & COMPLAINTS
We are committed to delivering exceptional professional standards. If you have an inquiry, feedback, or grievance regarding our services:
1. Contact Principal Migration Agent Rajbir Singh Deol in writing to allow for internal review and amicable resolution.
2. If a grievance cannot be resolved internally, you maintain the right to lodge a formal complaint with the Office of the Migration Agents Registration Authority (OMARA):
